สมัชชาสังคมก้าวหน้า ร่วมกับกลุ่มอาจารย์ กลุ่มประชาธิปไตยก้าวหน้า และญาติผู้เสียชีวิตจากการสลายการชุมนุมเมื่อ 19 พฤษภาคม 2553 จะส่งตัวแทนมายื่นจดหมายเปิดผนึกถึงเลขาฯสหประชาชาติในวันที่ 26 ตุลาคม 2553 โดยรวมตัวที่หน้าประตูใหญ่สำนักงานสหประชาชาติ กรุงเทพฯ ตั้งแต่เวลา 12.00 น

สมัชชาสังคมก้าวหน้าได้ยื่นขอเรียกร้องให้

1.ให้เปิดเผยรายขื่อผู้ถูกกุมขังที่เกี่ยวข้องกับเหตุการณ์ทางการเมืองทั้งหมด

2.ให้ปล่อยตัวนักโทษการเมืองทั้งหมด

3.ให้เร่งเปิดเผยผลสอบสวนกรณีเหตุการณ์ความรุนแรงเดือนพฤษภาคม เพื่อนำตัวผู้ที่ละเมิดสิทธิมนุษยชนมาดำเนินคดีตามกระบวนการกฎหมาย

ทั้งนี้ จึงขอให้ “เสื้อแดง” มาร่วมในการยื่นจดหมายเปิดผนึกในครั้งนี้

เรียน ท่านบันคีมุน เลขาธิการใหญ่สหประชาชาติ

เราเขียนจดหมายฉบับนี้ถึงท่านด้วยความเชื่อถือต่อบทบาทที่ผ่านของท่านและสห ประชาชาติในการผลักดันความเป็นประชาธิปไตยและสิทธิมนุษยชนให้เกิดขึ้น อาทิ การรณรงค์ของท่านเพื่อความประชาธิปไตยในพม่า ซึ่งท่านได้ใช้ความพยายามอย่างจริงจัง

ในประเทศไทย เป็นที่ทราบดีว่ารัฐบาลได้ใช้กำลังทหารกวาดล้างการชุมนุมเสื้อแดงเมื่อเดือน เมษายน และพฤษภาคม ด้วยความรุนแรงจนมีผู้เสียชีวิตอย่างน้อย 91 ศพ บาดเจ็บหลายพันคน ผู้สูญหายหลายสิบคน มีผู้ถูกจับกุมหลายร้อยคน ช่วงเวลาดังกล่าว คุณนาวี พิลเลย์ ข้าหลวงใหญ่คณะมนตรีสิทธิมนุษยชนแห่งสหประชาชาติได้กล่าวเรียกร้องให้ไทย ตั้งคณะกรรมการอิสระขึ้นมาสอบสวนกรณีเหตุการณ์ความรุนแรงที่เกิดขึ้นในไทย เมื่อเร็วๆนี้ เพื่อนำตัวผู้ที่ละเมิดสิทธิมนุษยชนมาดำเนินคดีตามกระบวนการกฎหมาย ทำให้พวกเรามีความเชื่อมั่นในจุดยืนของสหประชาชาติต่อการละเมิดสิทธิมนุษยชน ในประเทศไทย

ปฏิบัติการอย่างรุนแรงในเดือนพฤษภาคม ที่ทำให้มีการสูญเสียมากมายแล้วนั้น เป็นปฏิบัติการภายใต้อำนาจของพระราชกำหนดสถานการณ์ฉุกเฉินซึ่งเป็นกฎหมาย เผด็จการที่ละเมิดสิทธิและเสรีภาพขั้นพื้นฐาน ในการจับกุมก็เป็นเพียงข้อสงสัย ผู้ต้องขังจำนวนมากถูกซ้อมทรมานให้รับสารภาพตามรายงานที่ปรากฎบนพื้นที่สื่อ สาธารณะ และศาลตัดสินโดยจำเลยไม่มีทนาย ไม่มีการสอบพยานบุคคล อาศัยแต่เพียงคำสารภาพจากการซ้อมทรมาน จนกระทั่งบัดนี้ รัฐบาลยังไม่เคยเปิดรายชื่อผู้ถูกจับกุม

 ดังนั้น เราจึงขอให้ท่านนำข่าวสารของเราไปยังนายอภิสิทธิ์ เวชชาชีวะและรัฐบาลไทย ดังนี้ 

1. ให้เปิดเผยรายขื่อผู้ถูกกุมขังที่เกี่ยวข้องกับเหตุการณ์ทางการเมืองทั้งหมด

2. ให้ปล่อยตัวนักโทษการเมืองทั้งหมด

3. ให้เร่งเปิดเผยผลสอบสวนกรณีเหตุการณ์ความรุนแรงเดือนพฤษภาคม เพื่อนำตัวผู้ที่ละเมิดสิทธิมนุษยชนมาดำเนินคดีตามกระบวนการกฎหมาย ตามข้อเรียกร้องของข้าหลวงใหญ่คณะมนตรีสิทธิมนุษยชนแห่งสหประชาชาติ

Dear Sir,

We are writing this letter to you with utmost respect to your role at the U.N. in working for the causes of democracy and human rights. We also very much admire your effort in campaigning for democracy in Burma.

Here in Thailand, it is widely known that the Thai government had resorted to violence when dispersing the red-shirt demonstration during April and May earlier this year. It resulted in at least 91 deaths, several thousand injured, scores of people went missing, and several hundred were arrested. During that time, Navanethem Pillay, the UN High Commissioner for Human Rights, had appealed to Thailand to set up an independent committee to investigate the matter and bring those who committed the human rights violation to justice. This gives us confidence in the stance of the U.N. regarding human rights issues in Thailand.

The government’s violent crackdown in April and May was done under the emergency decree whose law severely violates the most basic human rights. Moreover, arrests were done on suspicion charges.

Many detainees have been tortured to confess. The court would give verdicts without giving the detainees access to any lawyer. It would not seek any witnesses to give testimonies. Only the forced confession extracted under duress were used in court. Up until now, the government has not revealed the names of people they have arrested so far.

Therefore, we would like to ask for your help in demanding from our prime minister Abhisit Vejjajiva and our government the following matters:

1.     Reveal to the public the names of all citizens who were arrested.

2.     Release all political prisoners.

3.     Speed up the investigation process that looks into the violence crackdown on protesters and bring those who committed the human rights violation to justice, according to the call from the UN High Commissioner for Human Rights.
